This is a legal agreement between you (“Licensee”) and Duperrific. This agreement applies to licenses issued via this website and grants you non-exclusive limited license to use the digital goods sold by Duperrific on this website.
1.”Licensed Material” means any copy or visual representation generated digitally or by any other means including reproductions of the material. Any reference in this Agreement to the Licensed Material shall be to each individual item within the Licensed Material and also to the Licensed Material taken as a whole.
1.1 The Licensed Material is not being sold; it is being provided to the Licensee under the terms of this agreement, which allows for use of Licensed Material but does not transfer ownership. Also, you may not claim intellectual or exclusive ownership to any of The Licensed Material, modified or unmodified. Ownership remains with Duperrific.
2. Licensee is authorized to make any necessary modification(s) to the materials to fit his purposes. However you may not re-distribute or release any modifications as GPL or otherwise. This agreement does not allow for the use of Licensed Material for distribution in any existing open source projects or applications.
2.1 Licensee may not delete the credit text from the template source files but is, however, allowed to delete our credit links from any other visible place.
3. Licensee has the non-exclusive, non-transferable, non-sublicensable right to use the Licensed Material following commercial or personal purposes subject to the restrictions provided by the type of license as follows.
3.1 Individual License grants the licensee the right to use the material on one concurrent site only and only on the domain name declared when purchasing.
3.2 Multisite License grants the licensee the right to use the Licensed Material on five concurrent sites as long as the usage complies with the rest of the Agreement.
3.3 Developer License grants the licensee the right to use the Licensed Material on unlimited concurrent sites as long as the usage complies with the rest of the Agreement.
3.3 Licensee may alter, extend, manipulate and create derivative works of the Licensed Material.
3.4 Licensee may not sell, license or distribute any derivative work based on the Licensed Material.
3.5 Licensee may not post the Licensed Material online in a downloadable format or enable it to be distributed via mobile devices.
3.6 Licensee’s rights to the Licensed Material are worldwide and for the duration of the Duperrific’s rights in the Licensed Material.
3.7 Unauthorized use or failure to pay in full results in immediate termination of this license, and with it, Licensee’s rights to use the Licensed Material.
4. No ownership or copyright in any Licensed Material shall pass to Licensee by the issuance of the license contained in this Agreement. Except as expressly stated in this Agreement, Duperrific grants to Licensee no right or license, express or implied, to the Licensed Material.
5. Since Duperrific is offering non-tangible irrevocable, digital goods we do not issue refunds after the purchase of the License is made and the Material has been downloaded from Duperrific’s website.
6. After we have succesfully recived yout payment, your digital download will be available on your member profile area. You can download the licensed Material a limited number of times within a period of 24 hours after payment has been received.
7. Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
7.1 All support will only be granted on the support forum where it will be open and available to al the Licensees and not via e-mail or otherwise.
7.2 Licensee will receive full access to Duperrific’s support forum.
7.3 Duperrific offers support only on common issues and bugs that might occur, and not on customization issues.
7.4 Duperrific offers no support for installation, customization or administration of WordPress itself
8. Dperrific does not warranty or guarantee thematerials in any manner. We cannot guarantee they will function with any third party components, plugins or web browsers. Licensee should make sure that their host complies with the published Requirements of the Material.
9. The license contained in this Agreement will terminate automatically without notice from the Duperrific if Licensee fails to comply with any provision of this Agreement. Upon termination, Licensee must immediately (i) stop using the Licensed Material; (ii) destroy the Licensed Material; and (iii) delete or remove the Licensed Material from Licensee’s premises, computer systems and storage (electronic or physical) and promptly confirm same to the Iconfactory in writing.
10. Duperrific reserves the right to revoke the license to use the Licensed Material for good cause and elect to replace such Licensed Material with alternative Licensed Material. Upon notice of any revocation of such license, Licensee shall immediately cease using such Licensed Material and shall where possible ensure that its clients and customers do likewise. Licensee shall delete all electronic copies of Licensed Material from its electronic storage media, confirming the same to Duperrific in writing.
